Terms of business

What you're buying, and what you're not.

Written to be read. If anything here is unclear, ask before you pay rather than after.

1. Who you're contracting with

GenkanCo is the trading name of Umar Hussain, a sole trader registered in the United Kingdom, of 3rd Floor, 86-90 Paul Street, London EC2A 4NE. In these terms, "I" and "GenkanCo" mean that business, and "you" means the business buying the service.

These terms apply to every engagement unless something different is agreed with you in writing.

2. This is a business-to-business service

GenkanCo sells to businesses, not to consumers. By ordering you confirm you're buying in the course of a business. Consumer cancellation rights don't apply.

3. What the Compliance Flag Report is

For £395, one product is checked against fourteen Japanese legal and compliance gates, plus its brand position on the Japanese trademark register. You receive an Excel workbook and a phone-readable version of the same report, setting out each gate that fires, what it requires, an indicative cost and timeline, who to take it to, and the order to address them in.

One product means one product. A different SKU, a different formulation, a different size where the size changes the classification, or a different target category is a separate report, not a revision of this one.

4. When the clock starts

The standard turnaround is five working days. The next-working-day option is £790.

Working days are counted from the point I have complete answers to the intake questions — not from the point you pay. If your answers arrive incomplete I'll tell you what's missing; the clock starts when it arrives.

A rush shortens my time. It never shortens the checks.

5. What you have to give me

The report is only as good as what it's built on. You agree that the information you supply — product details, materials or ingredients, claims, packaging, links and brand names — is accurate and complete to the best of your knowledge, and that you have the right to share it.

If a finding later turns out to be wrong because the input was wrong, that isn't a defect in the report.

6. Revisions

One consolidated revision round, raised within 48 working hours of delivery. Counted in working hours, so a Friday delivery runs to Tuesday.

Everything comes in one list rather than a trickle. Silence past the window closes the project.

A change to the product, the SKU or the target category is a new job, not a revision.

7. Payment

Prices are in pounds sterling and are quoted as flat fees. Payment is due before work starts unless something else is agreed in writing.

If you go on to buy the Japanese listing build, the £395 is credited against it in full.

8. Refunds and cancellation

  • Before work starts — cancel for a full refund, no questions asked.
  • After the report has been delivered — not refundable. It's research work supplied in full, and it can't be returned.
  • If a rush deadline is missed — the rush premium is refunded. The base fee stands and the report is still delivered.
  • If a primary source is unavailable — the Japanese trademark register schedules outages. You're told the same day, and the rush premium comes back rather than the checks being compressed.

I may also decline a job and refund you in full if, having seen the product, I don't think I can check it properly. That's a better outcome than a report neither of us trusts.

9. The limits of the advice — read this one

This is the most important section on the page.

  • GenkanCo is advisory. It is not a law firm, a certification body, a registered Japan compliance agent, a customs broker or an importer of record.
  • Nothing supplied is legal advice or a certification opinion, and it must not be relied on as a substitute for either.
  • The service identifies where Japanese regulation is likely to apply to a product and what would need resolving, so those questions can be taken to the right specialist. It does not resolve them.
  • Costs and timelines given are indicative estimates to help you plan, not quotations, and not commitments by any third party.
  • Japanese law, the registers and ministry guidance change. A report describes the position as at its date.
  • Decisions about compliance, certification, registration, labelling and importation remain yours, taken on your own professional advice.

10. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that can't be limited by law.

Subject to that, and because this is a business-to-business service:

  • I'm not liable for loss of profit, loss of sales, loss of business, business interruption, wasted stock or freight cost, loss of anticipated savings, or any indirect or consequential loss.
  • My total liability arising out of any engagement is limited to the fees you paid for that engagement.

If you need a level of assurance beyond that, what you need is a Japanese regulatory law firm, and I'll say so.

11. Your information and confidentiality

Product information you send is treated as confidential and used only to produce your report. It isn't shared with anyone else, and it isn't used to build a competitor's report.

Personal data is handled as set out in the privacy notice.

12. Who owns what

Once you've paid, the report is yours. Use it internally, send it to your lawyer, your distributor, your freight forwarder or your board.

The underlying method, templates, rulebooks and checklists behind it stay mine. You can't resell the report as a product of your own or publish it as though it were independent certification.

13. Ending an engagement

Either of us can walk away before work starts. Once work has started, if you cancel, I'll refund what hasn't been earned and tell you plainly how I worked that out.

14. Changes to these terms

These terms may change. The version that applies to your engagement is the one published when you ordered. Changes aren't applied retrospectively.

15. Law and jurisdiction

These terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
